These Terms of Service (the “Terms”) govern your access to and use of GameSignal, including our website, dashboard, APIs, GitHub App, and related services (collectively, the “Service”). GameSignal is operated by Gail Sparks, doing business as GameSignal (“GameSignal,” “we,” “us,” or “our”). By using the Service, you agree to these Terms.
1. Eligibility and accounts
You may use the Service only if you can lawfully enter into a subscription transaction through Stripe. You must be the age of majority where you live, or have a parent or legal guardian accept these Terms and be responsible for your account. The Service is not directed to children under 13.
You are responsible for the information associated with your account, keeping your account credentials secure, and for activity taken through your account. If you use the Service for an organization, you represent that you are authorized to accept these Terms on its behalf.
2. GitHub and customer content
The Service connects with GitHub installations you authorize. Depending on the permissions you grant and repositories you activate, GameSignal may access and process repository and pull-request information, including descriptions, commits, changed-file metadata and content, comments, and configuration.
You retain ownership of your content. You give us permission to host, copy, process, transmit to our service providers, and display your content only as needed to operate, secure, support, and improve the Service. You are responsible for ensuring that you have all rights and permissions needed to provide content to the Service.
3. AI-generated output
GameSignal uses AI to generate drafts, summaries, and related suggestions. AI output may be inaccurate, incomplete, or unsuitable for your intended audience. You must review output before relying on it, publishing it, or using it in a production, legal, financial, safety-critical, or other consequential context. You are responsible for your use of generated output.
4. Acceptable use
You may not misuse the Service; interfere with its operation or security; bypass access controls; use it to violate law or third-party rights; submit malicious code or content; or use the Service to develop or train a competing AI model without our written permission. You must comply with GitHub’s terms and the terms of any platform where you publish content.
5. Fees, subscriptions, cancellation, and refunds
Prices, billing interval, applicable taxes, and subscription capacity are shown before checkout. Payments are processed by Stripe. By starting a paid subscription, you authorize recurring charges until you cancel.
Payments are non-refundable except where required by law. You may cancel through the Stripe billing portal. Cancellation stops future renewal; your subscription and Service access remain active through the end of the current paid billing cycle. We may change prices or plans prospectively with notice where required by law.
6. Intellectual property
The Service, excluding your content, is owned by GameSignal and its licensors and is protected by applicable intellectual-property laws. Subject to these Terms, we grant you a limited, revocable, non-transferable right to use the Service for its intended purpose.
7. Suspension and termination
You may stop using the Service at any time. We may suspend or terminate access if we reasonably believe you have violated these Terms, created a security risk, or used the Service in a way that could harm us, users, or others. Sections that by their nature should survive termination will survive.
8. Disclaimers and limitation of liability
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT OUTPUT WILL BE ACCURATE.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, GAMESIGNAL WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, DATA, OR GOODWILL. OUR TOTAL LIABILITY ARISING OUT OF OR RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF $100 OR THE AMOUNT YOU PAID US FOR THE SERVICE IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO LIABILITY.
9. Indemnity
To the extent permitted by law, you will defend, indemnify, and hold harmless GameSignal from claims, damages, losses, and expenses arising from your content, your use of the Service, or your violation of these Terms or applicable law.
10. Governing law and disputes
These Terms are governed by California law, excluding conflict-of-law rules. Subject to any law that requires a different forum, disputes arising from these Terms or the Service must be brought in the state or federal courts located in California, and you consent to their jurisdiction.
11. Changes and contact
We may update these Terms from time to time. We will post the updated version and revise the effective date. If a change materially affects your rights, we will provide additional notice when required by law. If you continue using the Service after the revised Terms take effect, you accept them.
